Criminal record check vs Police Clearance Certificate: what's the difference?

They aren't the same thing

“Criminal record check”, “background check” and “police clearance” are sometimes used loosely in conversation.

But when someone actually needs criminal-history information, the type of check and the purpose for which it will be used matter.

In South Africa, a private criminal-background-check service and an official SAPS Police Clearance Certificate are not automatically interchangeable.

Before requesting either, establish what the organisation or situation actually requires.

What is a criminal background check?

Criminal-background-check services can provide criminal-history screening for particular purposes.

One South African example is HURU.

HURU currently states that its Criminal Background Check:

• uses fingerprints;
• is conducted through Afiswitch using the SAPS fingerprint database;
• can report previous-conviction and/or pending-trial status; and
• is not the same as a Police Clearance Certificate.

HURU currently lists uses including certain employment screening and specified applications.

But its report isn't accepted for every purpose.

How long can a HURU check take?

HURU currently advertises different service levels, including approximately:

• Standard: 24–48 hours;
• Premium: 5 hours; and
• Priority: 2 hours.

These are not guaranteed turnaround times.

HURU's terms describe them as best-effort service levels and say processing may take longer depending on system availability.

Where are fingerprints captured?

HURU currently says customers can have fingerprints captured through participating PostNet and Jetline locations.

Because provider processes and participating locations can change, customers should confirm current requirements directly with the provider.

What is a SAPS Police Clearance Certificate?

A Police Clearance Certificate is an official document issued by the South African Police Service's Criminal Record and Crime Scene Management division.

SAPS says the certificate states whether criminal convictions have been recorded against an individual.

SAPS currently describes PCCs as being used by people requiring confirmation of their criminal status for:

• emigration;
• travel; or
• employment abroad.

How long does a PCC take?

SAPS currently says finalisation takes approximately 15 working days after all required documents are received by CR & CSM, excluding postal time.

SAPS also currently warns of a backlog affecting PCC waiting periods.

Treat this as current guidance, not a guaranteed turnaround.

The practical differences

Criminal background check such as HURU

• Provided through a private screening service.
• HURU's check uses fingerprints and the SAPS fingerprint database through Afiswitch.
• HURU describes it as checking previous-conviction and/or pending-trial status.
• Different service speeds are available.
• It may be suitable for certain employment-screening or other approved purposes.
• It isn't accepted for every official purpose.

SAPS Police Clearance Certificate

• Official certificate issued by SAPS CR & CSM.
• States whether criminal convictions have been recorded against the individual.
• SAPS specifically describes it for emigration, travel or employment abroad.
• Processing generally takes longer than HURU's advertised service options.
• The authority requesting the document determines what it will accept.

One isn't simply “better” than the other

It isn't as simple as choosing a fast check for local use and a PCC for international use.

The important question is:

What does the organisation, regulator, employer or process actually require?

A quicker criminal-background report is of little use if the requesting authority specifically requires a SAPS Police Clearance Certificate.

Likewise, not every ordinary screening situation necessarily requires a PCC.

Check the requirement before spending money or submitting documents.

A HURU check isn't accepted for every purpose

HURU currently says its Criminal Background Check cannot be used for:

• visa applications;
• Professional Driving Permit (PrDP) applications;
• PSiRA registration; or
• firearm clearance.

Requirements can change.

Customers and applicants should confirm current requirements with the organisation requesting the check and the relevant official authority where applicable.

What about nannies, carers and people working with children?

There isn't a simple “just get a criminal record check” answer for these roles.

Roles involving children or vulnerable people can involve additional safeguarding considerations and role-specific requirements.

South Africa has mechanisms including the National Register for Sex Offenders and Child Protection Register that can be relevant in particular contexts.

A general criminal-background check doesn't automatically replace every safeguarding check that may apply.

The appropriate checks depend on the role and circumstances.

Does a clear result mean someone is safe?

No.

A criminal-history check answers a defined question based on the records and process used for that check.

It doesn't establish someone's:

• future behaviour;
• trustworthiness;
• honesty;
• competence;
• qualifications;
• workmanship; or
• suitability for every role.

Likewise, the absence of a recorded conviction isn't a guarantee that a person poses no risk.

A result describes what that particular check found. It isn't a judgement of the person's character.

ID Verified is something different again

On Know a Pro, South African Pros complete identity verification as part of signup before their profile goes live.

Once completed, their profile can display the ID Verified badge.

ID Verified means the Pro completed Know a Pro's required identity-verification process.

It does not mean Know a Pro has performed:

• a criminal record check;
• a Police Clearance Certificate check;
• a police-clearance process;
• an NRSO check;
• a Child Protection Register check; or
• a general background investigation.

Identity verification and criminal-history screening answer different questions.

What should you ask when someone says “I've been checked”?

Rather than relying on the phrase alone, ask:

• What type of check was done?
• Who issued or provided it?
• When was it done?
• What does the result actually cover?
• Is that type of check appropriate for this role or requirement?
• Does the organisation requesting it accept that particular report?

The wording “background checked” can mean different things in different contexts.

Ask what was actually checked.

The bottom line

A criminal-background check and a SAPS Police Clearance Certificate both relate to criminal-history information, but they are different products used for different purposes.

Don't choose between them simply on speed or convenience.

First establish what the check is needed for and what the relevant organisation or authority requires.

For sensitive roles, remember that criminal-history screening may also be only one part of the checks that matter.
